THE ISSUES OF ENSURING STATE SECURITY BY FORCES OF THE NATIONAL GUARDS OF UKRAINE

Abstract

Ukraine acquired the experience of concentrating efforts of law enforcement forces to resolve socio-political crisis situations, their organization in interspecific groups and application under one leadership. As convinces this experience, law enforcement forces  copes with tasks. Never before did the state authorities put forward complaints about the ineffectiveness of the actions of law-enforcers in measures at the national level of confrontation with the protesters.

However, today, society and the state are confronted with a situation where in tumultuous disturbances dozens and hundreds of thousands of people, including offenders, are well-organized and tuned, technically equipped and trained, which do not limit themselves in methods and means of action.

This situation creates a lot of problems for law enforcement forces  in ensuring state security, which is connected with legislative restrictions on the application of necessary measures and means.

The purpose of the paper is to bring to the bodies of state power the main problems concerning the provision of state security by the forces and means of the National Guard of Ukraine with the hope of further constructive legislative provision of the forces of the Guard and the law enforcement forces  in general.

After the creation of the National Guard of Ukraine, extending of its functions comparing to the Internal troops of the Ministry of Internal Affairs of Ukraine, the direct formulation of the issue of ensuring state security using the forces of the National Guard of Ukraine, as well as appointing it as a main force of riot control, caused a lot of issues in organizing the activities and interaction of law enforcement agencies, authorities, as well as local self-government bodies.
